1. Acceptance of Terms

By downloading, installing, or using the OCTA mobile application ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

OCTA is a mobile application for UFC and MMA fans to:

• Predict fight outcomes and earn points
• Access AI-powered matchup analysis
• View fighter statistics and rankings
• Participate in community forums and groups
• Compete on leaderboards

Free Features

All users have access to basic picks, limited analysis, and community features.

Premium Features (OCTA Premium)

Premium subscribers ($4.99/month or $39.99/year) unlock:

• Advanced picks with method, round, and confidence predictions
• Full AI matchup analysis for all fights
• Unlimited group creation and membership
• Detailed fighter statistics and comparisons
• Full leaderboard access

3. Account Registration

Eligibility

• You must be at least 12 years old to use OCTA
• You must be at least 18 years old to purchase a subscription (or have parental consent)
• One account per person

Account Security

• You're responsible for maintaining the confidentiality of your account
• You're responsible for all activities under your account
• Notify us immediately of any unauthorized use
• We're not liable for losses due to compromised credentials

4. User Conduct

Acceptable Use

You agree NOT to:

• Harass, abuse, or threaten other users
• Post spam, advertisements, or promotional content
• Share illegal, harmful, or offensive content
• Impersonate others or create fake accounts
• Use automated tools (bots, scrapers) to access the Service
• Attempt to hack, reverse-engineer, or compromise the App
• Share copyrighted content without permission
• Manipulate picks, scores, or leaderboards through exploits

Community Guidelines

In forums and groups:

• Be respectful of diverse opinions
• No hate speech, discrimination, or targeted harassment
• Keep discussions relevant to MMA/UFC
• No sharing of pirated fight streams or illegal content

Enforcement

Violations may result in:

• Content removal
• Temporary account suspension
• Permanent account termination
• Reporting to law enforcement (for serious violations)

5. User-Generated Content

Your Content

• You retain ownership of content you post (picks, forum posts, messages)
• By posting, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the App
• This license ends when you delete your content or close your account

Content Responsibility

• You're solely responsible for your content
• We don't pre-screen all content but reserve the right to review and remove content that violates these Terms
• We're not liable for user-generated content

6. Predictions and Picks

Entertainment Only

• OCTA is for entertainment purposes only
• Picks and predictions are for fun, competition, and social engagement
• We do not facilitate gambling or real-money betting
• OCTA does not accept, place, or process bets

No Guarantees

• AI analysis and statistics are provided "as-is"
• We make no guarantees about prediction accuracy
• Past performance does not indicate future results
• Do not use OCTA predictions for real-money gambling

7. Subscriptions and Payments

OCTA Premium

• Subscriptions are processed through Apple's App Store
• Monthly: $4.99 USD per month, auto-renewing
• Annual: $39.99 USD per year, auto-renewing, includes 7-day free trial

Free Trial

• New subscribers get a 7-day free trial on annual plans
• Cancel anytime during trial to avoid charges
• Trial converts to paid subscription unless cancelled

Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Your Apple account will be charged within 24 hours prior to renewal
• Subscription fees are non-refundable except as required by law

Managing Subscriptions

• Manage or cancel subscriptions in iOS Settings → Your Name → Subscriptions
• Or use the "Manage Subscription" link in the OCTA app profile screen

Refunds

• Subscription refunds are handled by Apple per their refund policy
• Contact Apple Support for refund requests
• We cannot process refunds directly

8. Intellectual Property

OCTA Ownership

We own all rights to:

• The OCTA app, code, design, and branding
• Our proprietary AI analysis algorithms
• Original content we create

Third-Party Trademarks

• UFC®, fighter names, and official UFC data are trademarks of Zuffa, LLC
• We display this information under fair use for news/statistics purposes
• OCTA is not affiliated with, endorsed by, or sponsored by the UFC

Your License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Third-Party Services

OCTA integrates with:

• Supabase (data storage, authentication)
• RevenueCat (subscription management)
• Apple (payment processing)

These services have their own terms and privacy policies. We're not responsible for their practices.

10. Data and Privacy

Your use of OCTA is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key Points:

• We don't sell your personal information
• You can delete your account and data at any time
• We use encryption and security best practices

11. Disclaimers and Limitations of Liability

Service "As-Is"

• OCTA is provided "as-is" and "as available"
• We make no warranties about reliability, availability, or accuracy
• We don't guarantee uninterrupted or error-free service

No Gambling

• OCTA does not constitute gambling advice
• We're not responsible for gambling losses based on app predictions
• Use predictions for entertainment only

Limitation of Liability

To the maximum extent permitted by law:

• We're not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months
• We're not liable for third-party content, actions, or services

Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of others' rights

12. Termination

By You

• You may stop using the App and delete your account at any time
• Email nickcamacho15@gmail.com to request account deletion

By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Required by law
• We discontinue the Service (with reasonable notice)

Effects of Termination

• Your access to the App ends immediately
• Your user-generated content may be deleted
• Some data may be retained per legal requirements
• Paid subscriptions are non-refundable unless required by law

13. Modifications to Terms

We may update these Terms at any time. Changes will be effective when posted. Significant changes will be notified via:

• In-app notification
• Email to your registered address

Continued use after changes constitutes acceptance of new Terms.

14. Modifications to Service

We reserve the right to:

• Modify or discontinue features
• Change subscription pricing for new subscribers
• Add or remove content
• Update AI algorithms and statistics

15. Dispute Resolution

Informal Resolution

Before filing a claim, contact us at nickcamacho15@gmail.com to attempt informal resolution.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action.

16. General Terms

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and OCTA.
• Severability: If any provision is found unenforceable, the rest of the Terms remain in effect.
• No Waiver: Our failure to enforce any right doesn't waive that right.
• Assignment: We may assign these Terms; you may not assign without our consent.
• Force Majeure: We're not liable for delays or failures due to events beyond our reasonable control.

18. Apple App Store Requirements

Third-Party Terms

Your use of the App is also subject to Apple's terms:

• Licensed Application End User License Agreement (EULA)
• App Store Terms of Service

Apple as Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms and may enforce them.

Acknowledgments

• Apple has no obligation to provide maintenance or support
• Apple is not responsible for the App or its content
• Apple is not responsible for addressing claims relating to the App
• Apple is not responsible for intellectual property infringement claims
